Terms of Use

These terms apply to the RareBites iOS app. By using it, you agree to them. The operator is named in the Imprint.

RareBites is a game, not a food-safety tool. The app guesses what a dish is from a photograph, and it is sometimes wrong. Never rely on it to decide whether something is safe for you to eat. If you have an allergy, an intolerance, a medical condition, or any doubt about a dish's ingredients, ask the person who made it.

What the app does

You photograph a dish. The app identifies it and adds it to your collection. Identification is automated and best-effort: names, countries, rarity and descriptions are generated and curated for play, not for reference. They may be inaccurate, incomplete or out of date.

Free use and RareBites+

RareBites is free to download and includes a fixed number of identifications. Those do not refill. Once they are used, further identifications require RareBites+.

RareBites+ is an auto-renewing subscription, also available as a one-time purchase. Prices are shown in the app in your local currency before you buy. Payment is charged to your Apple ID at confirmation. A subscription renews automatically unless cancelled at least 24 hours before the period ends, and is managed in your Apple ID settings. Where a free trial is offered, any unused portion is forfeited when you buy a subscription.

Fair use

"Unlimited" means unlimited normal use. Every identification costs us money, so RareBites+ carries a generous daily ceiling that exists to stop automated abuse and runaway cost. Nobody photographing their own meals will reach it. We may adjust it if the service is being abused.

Refunds

Purchases are made through Apple, and refunds are handled by Apple under their terms. We cannot issue them. Consumers in the EU keep their statutory rights.

Your photographs

Your photographs and your collection are yours. You give us only the permission needed to identify a photograph you submit — see the Privacy Policy for what that involves. We do not store your photographs and claim no rights over them.

Do not photograph things you have no right to photograph, and do not use the app to submit unlawful content.

Acceptable use

We may suspend access to the identification service where these are broken.

Our content

The RareBites name, the app, its artwork and its dish catalogue are ours and are protected by copyright. Screenshots of your own collection are yours to share freely.

Availability

The app depends on services we do not control, including Apple and OpenAI. We do not promise uninterrupted availability, and identification may be temporarily unavailable. Where an identification fails, the app returns the catch you spent.

Liability

We are liable without limitation for intent and gross negligence, and for injury to life, body or health. For slight negligence we are liable only where a material contractual obligation is breached, and then only for foreseeable, typical damage. Liability under the German Product Liability Act is unaffected. Nothing here limits liability that cannot be limited by law.

Changes

These terms may change as the app changes. The date at the top will say when. Continuing to use the app after a change means accepting it.

Governing law

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, you keep the protection of the mandatory law of your country of residence.

Apple

Apple is not a party to these terms and has no responsibility for the app. Apple's standard licence terms for App Store applications also apply, and where they conflict with these terms, Apple's terms govern to the extent of the conflict.
